complicated....car wreck while pregnant, baby with "issues"
 
ok dont quote i may come back and delete...

almost a year ago we were involved in a hit and run. drunk driver with "extensive criminal history". i intentionally did NOT settle on me bc i was pregnant with dd at the time. i suffered whiplash and abdominal trauma and had cramping and back pain(still have back pain). i was diagnosed with a SCH in the ER (and told it was an ectopic pregnancy which it wasnt). anyways. i settled on the other kids bc they were buckled and checked out and fine with no complaints.
dd has been having seizures and other issues since birth(low muscle tone, sensory type issues and probably a lot we dont know yet). so far we do NOT know why she is having issues(but will have the test results from neuro monday). the doctors have specifically asked if there were any accidents or trauma during the pregnancy and cannot rule out the wreck as having caused issues(unless of course the testing comes back with something concrete). obviously im not looking for $$ if they come up with some absurd genetic reason(we have no history of issues but theres always a chance) BUT if its possible that the wreck is the cause of her problems and she will be needing continued therapies and help then i do think the dumb butt's insurance should cover it. (actually i think he should but it doesnt work that way) but his insurance is pressuring me to settle before we have any answers and i refuse. im not comfortable with that. at all. we are also seeing a lawyer monday about it and he feels there is a valid case.
any opinions? am i doing the right thing? the driver's insurance just chewed me out bc i explained WHY i wasnt settling yet and she got all huffy with me. :banghead: i know thats her job but still.

I think you are doing the right thing. My dd has those things and we didn't get a diagnosis until she was a year old. Her medical bills are very significant. You want to be able to provide the best for your baby.

thanks. and, yes, i may be grasping at straws, but i would love to know "why" she has these issues, kwim?

can i ask what her diagnosis is?
so far all the specialists agree that she has something going on, but no one can pin point a reason so far

Sounds to me like his insurance thinks you may have a case too and are trying to settle do they don't have to pay. I think your doing the right thing.

If your lawyer says wait then wait. Next time the other insurance company calls can you tell them to talk to your attorney? Then you won't have to deal with them.

I would not settle. You are doing the right thing. I settled for a work related injury due to the abuse I was sustaining from the insurance company and my employer. I regret it to this day. Been butt poor and out of work due to trama for 6 years now. Stand your ground.

i havent actually retained the lawyer yet. that will be monday, depending on the test results. i really have just been trying to wait for the results but the insurance cally multiple times a week:/ i dont have time for that, i have a baby who screams 14 hours some days:(

you are definitely doing the right thing! How insensitive of the insurance agents!! I would lose it with them if they pressured me again....I'd probably end up threatening harassment charges if they called me again :blush: I know it's completely ridiculous, but it sounds like something I would say to someone so rude and moneygrubbing.
