If it were me, i'd keep it as simple as possible and just return the item for the full refund. You can go through eBay to try and get your return shipping refunded but they may not do that. Also, depending on how his listing was written, there is the small potential that they could side with him. If seller write "as is, no returns" in the listing then it's final.
