Yes, it's stealing, but it would depend on the amount of abuse/neglect. If animal control couldn't help, then I'd understand her POV. I've been in a situation where I tried multiple times to report neighbors, but animal control said we were out of their jurisdiction and the sheriff's dept didn't ever come check it out, even after several complaints.
