Smashed package, who's responsible?

I just got a sunglasses case I bought on eBay, and USPS totally smashed it. It was shipped in a lightly padded envelope. It looks like an elephant sat on it. What do I do? I really don't think the seller did anything wrong.

I would see if the seller would be willing to split the cost with you. Neither of you are at fault for the damage, but if you didn't purchase insurance then neither of you are going to recover the cost either. It's really not fair for either of you to be totally out the cost, but maybe they'll be willing to split the difference

Sunglasses case in any envelope equals improper packaging. All breakable items need a box at least. I say sellers fault.

i say sellers fault, and even it was/is USPS fault they still need to refund you and file with USPS, thats why sellers should always buy insurance. It is ALWAYS the sellers responsibility to purchase insurance even if buyer declines to pay for it

I agree that if something can get damaged in a padded envelope it should be packaged in a box.
