Sunglasses should be in a box, not a padded envelope. So, if the seller doesn't properly package it, how is it not their fault? The seller buys insurance, not the buyer, as insurance protects the seller.

So, yeah, you should be refunded in full.

I agree too but I would not expect a hard shell case to get damaged... I contacted the seller so we will see. It's a little tricky because there were glasses too, which survived, so this would be more of a partial refund situation I suppose? I really wanted that case too, so sad.

I would say a partial refund then, bc it wasn't packaged appropriately.

This is true. If a hard-shell case was smashed like that, it would definitely have been smashed even if it were packed in a box, since the case is surely sturdier than cardboard.

However, the seller is still responsible - even if the item was properly packaged and the USPS is at fault. Sucks, but that's eBay policy.

OP - You're a very understanding buyer! Wish all of them were like you.

Its not the buyers job to purchase insurance. It's the sellers.

Ultimately, the seller would be held responsible for this.

Re: Smashed package, who's responsible?

The seller should never have put something fragile into an envelope like that! Also, was the package marked "fragile, or breakable"? That would be the fault of the seller for not packaging the product correctly. It should have been put in a box, and stuffed with padding to protect the glasses. Also, anything sent breakable should have been insured.

I say, you have a few options:
~Tell the seller what happened and let them know the package was not properly done.
~Go to the post office and show them how they handled your package
~If nothing was done either way, file a dispute with paypal (and the place you purchased the item).
~You could do nothing, but then no one would learn a lesson.

Totally sellers fault! Those are fragile and should have gone in a box with bubble wrap or something.

I recently shipped a CJ's butter stick to a customer and it got smashed. I just had it in a polymailer. I refunded them completely and now I know we have to be more careful shipping them. This situation is just like yours.

Definitely seller at fault. It should have been packages in something hard like cardboard and marked as fragile.
