I know nothing about TX law specifically but I do think you have a case. That child needs care and if it will help you care for her teeth and other areas I would apply for it. I would be tempted to try for some sort of custody based on lack of care and refusal to pay for needed care! IMO cavities are needed care! Yes I have some as an adult I am choosing to care for my child over myself. But I am an adult I can make those decisions for myself. Ex doesn't pay CS. He just doesn't. I think it is neglect IMO when it comes to children.

awww...poor kiddo....I would imagine that TX courts would be concerned about neglect of care...my kids are in head start here in TX and we have to bring proof of all well-child appointments and dental appointments....they are considered REQUIRED care.

I have no idea about child support...but from you have said I think it would be worth some paperwork hassle to have it looked at...

Given the neglect on the part of the mother- no toothbrush, clothing, medical care or dental, why aren't you looking to get full custody and c/s from the mom?

You can go back to court to adjust cs every 3 years or even sooner if the pay he makes has significantly changed. You should def go to court to lower it!

i think they calculate at minimum wage if you have no income... my sisters, husbands ex is supposed to be paying them around 250ish i think for 1 kid.

and you can get it reevaluated like someone said previously

I am wondering if you can just not send her back then contact CPS in your area or on tx and say we would like emergency temporary custody. & then apply for custody in tx

Check TX state CS websites. They usually link to the state regulations. My state has a payment chart based on gross income, explanations and situations, exceptions, etc.

If it's anything like here, a significant income change (30% gross income change in either direction), you can request a change in the amount regardless of the time limit between hearings.

You'll know if you find the regulations. It will have that weird little squiggle that looks like two S's intertwined. If I wasn't mobile I would look for you.

If you're complying with paperwork requirements for showing he is displaced rather than wilfully unemployed, you should have no issue on that front for a reduction.
