Sigh...Are there going to be patents on AIOs now?

As a WAHM I got a bit leery when reading of Rumpsters having a patent pending for their AIOs. Why? Because after pockets having a patent and us not being to sell them without a license, I don't want to go down that route just because I make AIOs and now I'm going to have to buy a license for that too! I haven't done much research yet about this but am hoping someone will share what they know.

Anywho, how long do patents take anyway? And there must have been AIOs before Rumpsters, right? Please reassure me, I hate not being able to sell pockets even though I make SS ones for my son, and now with this...

What makes their AIO's so different than any othe AIO? If nothing and they are trying to patent AIO's in general then what is next? Covers? If so, I am out of a business. This is getting silly.

I thought Rumpsters was patent pending since I started cding last Oct. And I don't think they are patenting a "general AIO", right? More along the lines of their design which is a good move IMO.

I was under the impression they were patenting their design...not an AIO. Since they have such a unique flap design inside and all.

Their design is different than the typical AIO with their fold out flaps, so I imagine that would be what they're patenting. But I understand your concern. That mess with the pocket licensing last year is something I'd hate to see happen again.

Well, they say, and I quote; "In this well fitting, beautifully designed AIO (patent pending), there are 5 layers of 55% Hemp 45% Certified Organic Cotton. There is an outer layer of solid colored 100% Polyester PUL and an inner layer of Malden Mills micro fleece for the stay-dry feeling next to your baby's skin. Our Aplix closures include a fold-back wash tab to keep your hook and loop tape from snagging any other item in your wash. To top it all off, if your baby is a heavy wetter; the internal flaps create a pocket for you to insert an additional doubler inside."

SO, the only thing that is different from any AIOs is that it has internal flaps that create a pocket to insert an additional doubler.

And if everyone went out and patented their designs, no one could make anything. I DO agree to protect your pattern, but to put a patent on HOW many layers there are, closures, outer waterproof fabric, inner stay-dry liner, etc, then we WAHMs won't be able to sell AIOs that we make, even if we've never SEEN a Rumpster AIO!

This is the way of capitalism. My husband works designing well-known vacuum cleaners. Everything unique needs its own patent. Even the way an air filter is positioned in the waste collection canister.

Patents protect the creator and allow them to benefit from their work. You can view it as a stumbling block or as a launch pad to greater ideas. Consider how Swaddlebees has taken the pocket diaper concept--improved on it--and has made the innovative AIO diaper with a pocket. Now their new design is being copyrited. and the pocket diaper licensing doesn't apply to this new design.

She cannot patent an actual AIO diaper. The only thing she can patent is her soaker style...which I am not even sure she can patent that. I have never seen a rumpster inside but, I think it is similar to another well known WAHMs (who has been around for several years now). Anyone can apply for a patent (and say patent pending) whether they get it or not is the million dollar question.
