at all? or exspecially if you're a business?

I would think that if you are in a state with a proper use clause then it would be for sure. Aside from that, probably not. It's definitely a no-no to use an expired seat, but probably not illegal if your state doesn't require "proper use".

It's not inherently illegal, per se, and it does vary from state to state (and counties, therein). I don't remember details, but consigners with business licenses do generally take on some liability when selling used child restraints. But 1) they're oblivious to it and/or 2) there's really no follow-through to enforce it, so consigners continue selling them.
eBay is kind of hit and miss... sometimes they enforce it, sometimes they don't. They even had a custom made carseat (as in someone had made custom carseats to fit in a Hummer, eek) auction up and refused to pull it.

And Craigslist/Kijiji postings are only pulled if they're flagged, but there's no limitation re: original postings, unfortunately.

I wish it were illegal. It would make some aspects of the tech world a lot easier/safer.
