She has State Farm. I didn't file w/ my insurance co. because I am not the one at fault. I didn't see any reason to jack up my rates, pay a deductable, etc when her insurance should be the one paying for it KWIM?

Yes, these suck because insurance companies will do whatever they can to point the finger at the other person meanwhile I suffer and the girls vehicle is driveable so she can continue to drive around living her life while I am afraid to get into my car. NICE! I am just so mad!!!

Then she said "well, if you have kids and when they start to drive and when something like this happens I hope you never have to go through it and maybe someone will be a little more nice with you than you're being with me". I said, I am being nice, I am exercising my right to go through insurance and there is nothing that says I have to let your ex fix my vehicle!"


My parents had five daughters and I am the only one that didn't get in multiple accidents while still living at home. (I havn't been in any, knock on wood). All of the accidents went through their insurance. It isn't that big of a deal. Sounds like this lady is going to have to get used to it with a daughter like that.

Thank you for that. I just wanted her to understand that if my dd did this to someone I would be honest, accepting, and totally willing to let her file because it is safer to do it that way. Some people will do anything to let their kids get away with something and/or avoid having to pay for what their children did. They are our responsibility. We need to act appropriately on behalf of them.

You have pictures right? Did you take pictures of the scene? (to prove there was NO garbage can?)

I am thinking everything will be ok though....because SHE was the one in reverse...anytime there is a wreck in aparking lot the one in REVERSE automatically takes the blame. I am pretty sure of this (as my dad was in a wreck once backing out of a spot and a woman who wasnt paying attention drove INTO HIM and he had to pay because he was in reverse)

I am sure the daughter is just grasping for straws trying to figure out why it isnt her fault typical teenager and her parents "believe her" OR the parents should be tar and feathered because they are trying to get out of it since you didnt want to do it "their way"

Thanks! There was a dumpster but it wasn't blocking her view of me. I think what she is trying to tell them is that I came around the corner and she didn't see me enter the lot so she backed up thinking no body was there. I came straight across the parking lot and into this one right behind her. She entered first and I came in behind her and totally visable through her rear view mirror and side mirrors but she didn't use them. It was like I was driving in a straight line and she was in front of me.

She'll get caught on that lie since I didn't come in the way she said I did nor is the garbage can in her way in any way shape or form.

Her mom asked why she didn't hear anything and the girl admitted that she had her music on. He dad said that she needed to "turn down the music and pay attention" so they both know she is at fault. They just don't want to pay the deductible and higher insurance rates! BAD BAD BAD parents!

ETA: I took pics of her car and mine and of the lot where it happened. We didn't take pics right when it happened. Her parents showed up after we moved into parking spaces w/ a camera and my dh came later with ours. Pics are in my first post above.

I would go through your insurance agent. Your insurance will fix your car for you and then go after the other insurance company. They will not jack up your rates for an accident that wasn't your fault, nor will they eat the cost of the accident.

I think this is the biggest "issue" with inexpirienced drivers...I think this is one thing they need to push more in drivers ed.

For some reason my dad told me when I started driving to pay attention to EVERYTHING ALL THE TIME...

Ok, one thing thats bothering me though....she didnt HEAR the metal rubbing...but unstead she just had to push the gas harder? I mean, any type of resistance is going to make you have to push the gas harder? LOL

Reminds me one time about a girl pulling into a parking spot. She hit a SUV going in and unstead of stopping and backing up she just kept GOING. The SUV was rocking....the noise was horrible...and with the size of that dent (and the way the SUV was rocking) she must have been flooring it to finish getting into the spot. SHe then got out of the car and was walking away when someone said "excuse me, you just hit that SUV" and she was like "no I didnt" and she looked at the damage and couldnt believe SHE did it because "She would have noticed" Luckily the owner came out right after that and they went in the store to look at the tapes from the camera because the girl still didnt believe she hit the SUV.... We stuck around until the owner of the SUV came out...but we stayed out of it! LOL..

They will reimburse your decuctible. I was hit by an uninsured motorist. I got my deductible back after they sued the guy and won.
