I really don't see how that's legal. The man expected he was alone in a confessional with a priest. It's privileged. They can't tape you with your lawyer, either. You have an expectation of privileged contact with religious counselors and lawyers acting on your behalf, and no judge in his or her right mind would sign a warrant for a wire tap to listen in on those conversations.

I would be very intersted in where these cases took place. Honestly, I find it difficult to believe and couldn't find the info in a quick google.

A tap on a cell phone of this nature takes a certain amount of planning (I have no idea if it is in fact possible, but wouldn't put it past the realm of possilibity). Warrants are needed in all but the most unusual instances for a wiretap and if the police has that much suspicion, then should have time to get a warrant to put it into place.

I do believe over 90 pages of paperwork is needed to infringe on a citizens constitutional rights. And ALOT more manpower to enforce it (this coming from a very close and dear friend who ACTUALLY DOES this, doesn't just hear about it, lol....).. i doubt any of us should be leery of our cell phones, unless we are committing crimes. But yes, I KNOW almost anything is possible.

Your lawyer is privileged but while the priest can't tell anyone your confession I have never heard of it not being allowed if it is overheard. But if a warrant was signed it wasn't for listening to someones confession it was to tap the phone the confession happened to occur during the time the phone was tapped.
